Terms of Service

We select moments from a streamer's public Twitch broadcasts and clips, edit them into vertical short-form video using a combination of automated tooling and human review, and publish them on a schedule to platforms such as TikTok and YouTube Shorts. The specific accounts clips post to, the posting cadence, and any fees are set out separately when a streamer is accepted, and those specifics govern over anything general stated here in the event of a conflict.

The service is provided on a best-effort basis. Editing decisions — which moments to cut, how they're captioned, scored, or reframed — are made using automated systems that can make mistakes. We do not guarantee that any clip will be accurate, complete, free of errors, or that publishing will happen at any particular time.

Your stream is yours. By applying, you grant us a non-exclusive licence to access your public Twitch VODs and clips, and to cut, edit, caption, and publish short-form video derived from them, for as long as we're actively working together. That licence ends when either side ends the arrangement, though clips already posted before that point may remain up unless you ask us to take them down.

If posting requires connecting a YouTube, TikTok, or other third-party account, you're responsible for having the right to connect that account and for complying with that platform's own terms. We only use the access you grant to publish the clips we produce for you — nothing more — and you can revoke that access at any time, which stops future posting immediately.

You're responsible for the content of your own broadcasts. We don't pre-screen your streams, and selecting a moment for a clip is not an endorsement of anything said or shown in your source material.

If you don't like a clip we've posted, tell us and we take it down — no argument, no notes round. If you believe any clip infringes a copyright you hold, send a takedown notice to [email protected] identifying the clip and the material you believe is infringed, and we will review and remove it promptly where warranted.

The service, and every clip it produces, is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the service will be uninterrupted, timely, secure, or error-free, or that any clip will perform on any platform in any particular way.

To the fullest extent permitted by law, Peak Clips and its operator will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of revenue, profits, goodwill, data, or viewership, arising out of or related to the service, even if advised of the possibility of such damages.

Where liability cannot be excluded, our total liability to you for any claim arising from the service is limited to the total fees you paid us in the three months preceding the claim, or one hundred US dollars, whichever is greater — or, where you have paid us nothing, is limited to zero.

You agree to indemnify and hold harmless Peak Clips and its operator from any claim, damages, liability, cost, or expense (including reasonable attorneys' fees) arising out of your breach of these terms, your content, or your misuse of the service.

Where the service connects to YouTube on your behalf, that connection and our use of it is additionally governed by the YouTube Terms of Service and the YouTube API Services Terms of Service. Our handling of any data obtained through Google APIs is described in our Privacy Policy and adheres to the Google API Services User Data Policy, including its Limited Use requirements.

Either side can end this at any time, for any reason, with no minimum term and no notice period. Tell us and we stop posting; we'll tell you what's already scheduled so nothing goes out unexpectedly. We may also suspend or end access to the service if we reasonably believe these terms have been broken, or if we believe continuing would expose us to legal or platform-policy risk.

We may update these terms as the service changes. The "last updated" date above reflects the most recent revision. Continuing to use the service after a change means you accept the updated terms; if you don't, you're free to stop at any time as described above.

These terms are governed by the laws of the State of Illinois, USA, without regard to its conflict-of-law principles, and any dispute arising from them will be brought exclusively in the state or federal courts located in Illinois.
